Does my Texas business need workers’ compensation insurance?

Employers, except for governmental entities and construction contracts for governmental entities, may choose whether or not to possess workers compensation insurance.

Even though Texas law does not require workers compensation insurance coverage, your customers may require that you carry that coverage in order to do business with them.

Failure to provide workers’ compensation insurance coverage

Employers choosing not to obtain workers compensation insurance coverage are considered “non-subscriber,” and must notify their employees and the Texas Division that you do not have workers compensation insurance by posting written notice in the personnel office.

Notice Postings

Notices must be in English, Spanish, and any other language necessary and must be in the wording and format detailed in TDI-DWC (Notice-5). If a notice is not correctly posted, the employer will be liable for any administrative violations. Notices also need to be in place if you do decide to become a subscriber of workers compensation insurance.

Personal Liability

Any employers who do not carry Workers Compensation insurance for their employees risk being personally liable for all medical bills from ANY accident. These employers may also be subject to significant governmental fines.

For contractors, having proof of Workers Compensation Insurance is usually required to be a subcontractor with a larger general contractor. Proof of Workman’s Compensation coverage is provided by a Workers Compensation Certification.
